U.S. Citizenship and Immigration Services (USCIS) has postponed the implementation of the new Form I-9. Initially, employers were to use the new Form I-9 beginning February 2, 2009. (For more information about the new Form I-9, please read our previous client alert.) On January 30, 2009, however, USCIS reopened the public comment period for 30 days and delayed the implementation of the interim final rule for 60 days. Therefore, the public has until March 4, 2009, to submit comments about the interim final rule, and employers must use the new Form I-9 starting April 3, 2009. Until April 3, 2009, employers must continue using the current version of Form I-9, which is dated June 5, 2007.
