On September 15, 2010, CBP published notice of its final determination in CBP Headquarter’s ruling letter (HQ) H107335 (September 9, 2010) concerning the country of origin of certain uninterruptible power supplies known as InfraStruXure Solutions (ISX) and certain individual units of the ISX which may be offered to the US Government under a government procurement contract. CBP concluded that ISX and certain units—assembled and programmed in the United States—were considered products of the United States for purposes of government procurement. In reaching its conclusion, CBP reasoned that the assembly, programming and installation by highly trained technicians of the ISX and certain units in the United States resulted in a substantial transformation of non- or partly functional devices into intelligent and fully functional network or data center uninterruptible power supply systems in the United States.
