Unnecessary Roughness. While unsportsmanlike conduct on the football field can draw a 15-yard penalty, unprofessional conduct at a healthcare facility can result in a lawsuit. That’s what happened to an Ohio hospital when a doctor kicked a surgical technician because he was upset that the technician took a scheduled break during surgery. The technician sued the hospital for physical and emotional damages from the assault. But the court threw a flag on the play. The court found that the surgical technician’s recovery against the hospital was limited to the workers’ compensation system because the technician was acting within her scope of employment when she was injured. This isn’t over. The court of appeals may review the trial court’s decision to see if the ruling on the field stands.
