The Pensions Regulator has updated its guidance on "Identifying your  statutory employer" in light of the decision in Trustees of the Olympic Airlines  SA Pension & Life Assurance Scheme v Olympic Airline SA [2013] EWCA Civ  634. The updated statement provides that, where a scheme has an  overseas employer, trustees will need to consider the effect that this will  have on the ability of the scheme to enter the PPF. The Regulator  highlights the need for trustees continually to monitor the economic activity  undertaken in the UK, as insufficient economic activity may effect whether a  UK insolvency process can be initiated.
