On May 1, 2016, I blogged about the Overtime Regulations issued by the Department of Labor. As reported by Robin Shea with the Employment Law Insider, on Tuesday, September 20, two lawsuits were filed in Texas challenging the regulations. Twenty-one states, including Alabama, filed the first lawsuit against the Department of Labor, Director Thomas Perez, the Wage and Hour Division of the DOL, Dr. David Weil as Administrator of the Wage and Hour Division and Mary Zeigler as Assistant Administrator for Policy of the Wage and Hour Division. A second lawsuit was filed in the same court a short time later on behalf of numerous Chambers of Commerce and Trade Associations.

I will follow up with additional information in the next several days to provide more details and thoughts about these new lawsuits, and the impact they will have on employers who could be impacted should the overtime regulations take effect on December 1 as currently scheduled.
