An employer was fined for breaching the State OHSW Act in failing to provide plant in a safe condition and safe systems of work. A fishing boat sank and two workers died. The boat had undergone modifications which compromised its stability and there was a failure to provide personal protective equipment in the form of life jackets which resulted in the employer being fined $200,000. This fine was reduced to $20,000 because of the employer’s diminished financial standing. The employer was also ordered to pay $5000 compensation to each of the deceased’s worker’s mothers and $10,000 to one worker’s partner and son. The employer was also directed to publish in newspapers on the importance of wearing personal floatation devices in the commercial fishing industry.
