On July 22, 2010, CBP Commissioner Alan Bersin announced that CBP expects to formally withdraw the proposed change to the first-sale rule. The change was originally proposed in 2008 and involved calculating the transaction value based on the price paid in the last sale that occurred immediately before the goods entered into the United States. The decision to withdraw the change was, in part, a result of the fierce opposition to the proposal by importers and Members of Congress. Although Bersin said he expected formal withdrawal of the proposed change to be published within 30 days, notice of the withdrawal has not yet been published.
