Further to the implementation of the ‘Market Model’ Act in the spring of 2011, the Regulation on consumers and monitoring under the Electricity Act 1998 and the Gas Act (Regeling afnemers en monitoring Elektriciteitswet 1998 en Gaswet), the Regulation governing the disconnect policy for small users (Regeling afsluitbeleid voor kleinverbruikers), the Regulation governing the tariff structure and conditions for electricity (Regeling inzake tariefstructuren en voorwaarden elektriciteit) and the Regulation governing the tariff structure and conditions for gas (Regeling inzake tariefstructuren en voorwaarden gas) will have to be amended in order to implement the Supplier Model (Leveranciersmodel) which was originally to have been implemented as of 1 April 2013 (Regulation of 8 February 2013, no. WJZ/12357329, amending several rules relating to the implementation of the market model, Government Gazette 2013, 3181). The consequences of the amendments will include an adjustment to the division of duties between suppliers and the grid manager with regard to the provision of information to small users regarding tariff changes and the conditions attached to the transport agreement. The Regulation of 14 March 2013 (Regulation of 14 March 2013, WJZ/13041852, Government Gazette 7424) amended the Regulation of 8 February 2013 such that the Regulation will now enter into effect on 1 August 2013. As prescribed by Article 12 of the Gas Act, a Royal Decree (Decree of 19 March 2013, Bulletin of Acts and Decrees 121), which will also enter into effect on 1 August 2013, has been issued for the implementation of the Regulation governing the tariff structures and conditions for gas.
