The U.S. Department of Agriculture (US DA) has issued a proposed rule that would revise the agency’s National Environmental Policy Act (NE PA) regulations by adding three new categorical exclusions for activities that restore land negatively affected by water-control structures, natural and human-caused events, and roads and trails. 77 Fed. Reg. 35,323 (6/13/12) The proposed rule would allow the Forest Service, part of US DA, to analyze and document the potential environmental effects of soil and water restoration projects by removing watercontrol structures such as dikes, ditches, culverts, and pipes; restoring lands and habitat by removing debris, sediment and hazardous conditions following natural or human-caused events; and restoring lands occupied by roads and trails to natural conditions. US DA requests comments by August 13, 2012.
