On 19 May 2011, the Office of Fair Trading (“OFT”) published the first decision taken by the Procedural Adjudicator. In the context of the OFT’s ongoing Competition Act 1998 investigation into the sports good retail sector, she has rejected an application by Sports Direct International plc for early access to a formal information request issued to a third party. Sports Direct will obtain access to this document if the OFT issues a statement of objections in this case, so protecting its rights of defence. The Senior Responsible Officer acted reasonably in deciding not to provide early access to this document. The Procedural Adjudicator also concluded that the OFT case team’s refusal to disclose further information about the nature and scope of the investigation at this time was not a procedural decision that fell within the scope of the Procedural Adjudicator trial.
