The FCC recently issued a Public Notice confirming that the new pole attachment rules governing timelines for access to utility poles, contractors for survey and make-ready, and complaints by incumbent local exchange carriers (ILECs) went into effect on July 12, 2011. Accordingly, all of the new pole attachment rules adopted in the FCC’s April 7, 2011 Report and Order and Order on Reconsideration are now in effect.
The FCC has also requested comment on two Petitions for Reconsideration of the new pole attachment rules. The National Cable & Telecommunications Association (NCTA), COMPTEL, and TW Telecom filed a joint Petition for Reconsideration to revise the FCC’s new telecommunications attachment rate. The Coalition of Concerned Utilities has sought reconsideration of several rules adopted by the FCC. Oppositions are due Wednesday, August 10, 2011, with replies due Monday, August 22, 2011.
