The Court of Appeal upheld the dismissal of the claimant's claim for professional negligence brought against his former solicitors for failure to issue his personal injury claim within the three-year limitation period. The limitation period ran from the date of knowledge in 2005, which was when the claimant's asbestosis was confirmed, and not from 2002 when he was he told that he had pleural plaques and that there was a possibility of asbestosis (Preston v BBH Solicitors - see also Sir Robert Lloyd & Co Ltd v Hoey).
