UK Visas & Immigration (UKVI) has extended the 'cooling off' period for sponsors in respect of sponsor licenses revoked on or after 6 November 2014.
If UKVI refused a sponsor licence application because a sponsor previously held a sponsor licence in any tier which UKVI revoked, sponsors are now not permitted to reapply for a licence until at least 12 months have elapsed from the date of the notification of revocation. Previously, sponsors were able to reapply after only a six-month cooling off period.
The cooling off period will not apply if UKVI refused an application because:
- it was submitted by a representative; or
- a sponsor did not provide documents or information which was requested by a specific deadline for reasons outside the sponsor's control.
UKVI has also amended the rules for surrendering a sponsor licence. Any licence which is surrendered while suspension or revocation proceedings are being taken will now trigger a 12-month cooling off period before the sponsor may reapply for a sponsor licence.
