Of interest to all schemes is TPR’s first auto-enrolment bulletin, which details TPR’s use of its enforcement powers where employers have failed to comply with their auto-enrolment duties.
TPR has published compliance and enforcement details showing it used its formal powers on 23 occasions up to the end of June 2014 to ensure employers comply with their auto-enrolment duties. The powers listed include the ability to carry out inspections and to issue statutory notices including fixed penalty and escalating fines.
TPR stated that, to date, the vast majority of employers are complying with their new workplace pension duties without the need for TPR to intervene. However, as the numbers of employers staging and due to complete their declarations of compliance rises significantly over coming months, TPR expects to see a corresponding increase in the number of occasions that we use our statutory powers and issue fines. These figures will be reported in subsequent quarterly bulletins.
TPR highlights the recent Supreme Court ruling on partners of Limited Liability Partnerships (LLPs). Consequently, it recommends LLPs assess their partners to ascertain whether they are a worker to determine whether they have any automatic enrolment obligations in respect of such partners.
