The European Commission (Commission) has found that three banana importers, Chiquita, Dole and Weichert (trading as Del Monte), participated in a cartel setting prices in eight Member States between 2000 and 2002. The retail value of the market in 2002 was around €2.5bn. Chiquita received total immunity for providing initial information of the cartel to the Commission and Dole and Weichert had their fines reduced by 60%, as the Commission took into account certain characteristics in the market, such as the specific regulatory regime for the banana market. Weichert received a further 10% reduction due to non-participation in part of the cartel. The Commission also found Del Monte jointly and severally liable for the fine imposed on Weichert, since it controlled Weichert at the time of the infringement.
