William Prym GmbH & Co.KG and Prym Consumer GmbH (Prym) have lodged an appeal against a CFI judgment to uphold the Commission’s 2004 fine of €30m for infringement of Article 81 by participating in a market-sharing cartel in the needles and haberdashery sector. A fine of €30m was also imposed on Coats Holdings Ltd and J&P Coats Ltd (Coats), whilst Entaco received full immunity. The CFI reduced Prym’s fine to €27m on account of not contesting the facts and reduced Coat’s to €20m in light of its more minor role in the cartel. Prym has appealed to the ECJ to annul the Commission’s fine or in the alternative grant a further reduction in the fine. Coats is only seeking a further reduction in the fine.
