The DHS US Immigration and Customs Enforcement (USCIS) issued a proposed rule that seeks to amend its regulations by rescinding the amendments it promulgated on August 15, 2007 (the August 2007 No-Match Rule) and October 28, 2008 (2008 Supplemental Final Rule). For additional information regarding these amendments, please see our July 2009 Immigration Alert.

The rescission of the No-Match Rule follows protracted litigation and an injunction, issued by the District Court for the Northern District of California in October 2007, which prohibited the Rule’s implementation. More information about the No-Match Rule can be found in our October 2007 Labor & Employment Alert and November 2008 Immigration Alert.
