According to a ruling promulgated by the Ministry of Economic Affairs on January 7, 2013, a shareholders meeting duly convened by a minority shareholder or supervisor should be treated as if the meeting is called by the company.  In order to protect the minority shareholder's or supervisor's right to convene the shareholders' meeting, such persons shall be entitled to request the Taiwan Depository & Clearing Corp. ("TDCC") to provide the shareholders roster.  However, considering that the shareholders roster usually includes personal data of shareholders which are protected by the newly-enacted Personal Data Protection Act, a minority shareholder or supervisor should retain a shareholder service agent to handle relevant matters, so that TDCC may provide the shareholders roster to the engaged shareholder services agent and shareholders’ rights and interests can be protected.
