Antiterrorism Bank Claims Remanded
U.S. nationals who were injured in attacks by Hamas in Israel sued National Westminster Bank (“NatWest”), arguing the bank had provided material support to a terrorist organization in violation of the Antiterrorism Act by maintaining bank accounts for a Palestine relief fund. The district court granted summary judgment in favor of NatWest. The Court reversed, holding that the Act requires only a showing that the bank had knowledge that, or exhibited deliberate indifference to whether, the fund in question provided material support to a terrorist organization, regardless of whether the fund’s support aided terrorist activities of the terrorist organization.
