The Trade and Industry Appeals Tribunal (College van Beroep voor het bedrijfsleven) has requested that it receive a “complete version” of a confidential report commissioned by the predecessor of the AFM on supervision of the securities market23 within two weeks.

The Court wants to assess whether it is appropriate for the AFM to keep this report confidential. The report, commissioned by the AFM and compiled by the auditors’ firm Coopers & Lybrand, deals with, among other things, the Regio Effekt and Nusse Brink cases. The problems surrounding these companies formed the prelude to a criminal investigation into securities fraud, known as the Clickfonds affair, ten years ago (from Het Financieele Dagblad of 1 April 2009).
