We write to remind you of important upcoming deadlines concerning the New Jersey Family Leave Insurance Provisions under the New Jersey Temporary Disability Benefits Law (the “TDBL”).

As we outlined in our Client Alert dated May 2, 2008, all New Jersey employers, regardless of size or status as a private or public employer, must begin to deduct from employees’ paychecks for Family Leave Insurance effective January 1, 2009 at the rate of 0.09% for the 2009 calendar year. Employees will become eligible to begin taking paid leave on July 1, 2009.

Employers are required to post notification of Family Leave Insurance in a conspicuous location in each of their workplaces no later than December 15, 2008 and employers must also provide each employee with a written copy of the notification. The written notification may be electronically transmitted to employees. The appropriate forms and additional information about an employer’s obligations under New Jersey’s Family Leave Insurance may be obtained on the New Jersey Department of Labor’s website.
