The Fair Work Commission has released a draft unfair dismissal practice note. The practice note aims to “provide procedural guidance regarding the scheduling and conduct of proceedings relating to unfair dismissal applications which do not settle at or which do not proceed to conciliation”. The practice note will be open for public consultation until 25 October 2013.
The practice note covers areas such as:
- extensions of time;
- orders for the production of documents and attendance;
- the process for determining the merits of a claim; and
- case management issues.
