The Medicare Prescription Drug, Improvement, and Modernization Act of 2003 requires group health plans ("GHPs") that offer prescription drug coverage to Medicare-eligible individuals, to disclose to the Centers for Medicare and Medicaid Services (CMS), at least annually, whether the GHPs' prescription drug coverage is or is not creditable. This disclosure is required whether the GHPs' coverage is primary or secondary to Medicare. GHPs must file a creditable coverage disclosure form electronically with CMS on or before March 1, 2007.
