Minister for Planning Bob Neill said in Parliament on 9 June that the Government is considering amending the Town and Country Planning (Compensation) (England) Regulations in relation to Article 4 directions (directions withdrawing permitted development rights) so that where an Article 4 direction is used to withdraw such rights for the demolition of non-residential buildings, compensation will only be available where an application for planning permission is submitted within 12 months. Further, where 12 months notice is given before an Article 4 direction is made, there will be no right to compensation at all.
