An OHS breach by an employer of failing to guard a pinch point which resulted in the tip of a worker’s finger being amputated has been the subject of a 40% discount on the fine, with the penalty being reduced from $85,000 to $51,000 pursuant to section 10B of the Criminal Law (Sentencing) Act 1988. Under this provision, defendants who plead guilty to offences less than four weeks after their first appearance in court can have their sentences reduced by up to 40%.
