The ACCC has released for comment a draft final access determination (FAD) for the declared wholesale ADSL service. The FAD once finalised, will apply until 30 June 2014. The FAD will provide terms and conditions on which access seekers can rely if they are unable to reach agreement with an access provider on the terms of access to the declared wholesale ADSL service. Although Telstra proposed that the ACCC set prices that directly address congestion on the ADSL network, the ACCC has indicated that it will not do so, as this would put ADSL access seekers at a competitive disadvantage compared to Telstra.
