EPA has published a proposed rule that would set criteria for determining when onboard refueling vapor recovery (ORVR) is in “widespread use” for purposes of controlling motor vehicle refueling emissions. 76 Fed. Reg. 41,731 (7/15/11). Section 202(a)(6) of the Clean Air Act, allows EPA to waive requirements for states to implement Stage II systems at larger gasoline dispensing facilities in areas that are in serious, severe, or extreme non-attainment of the national ambient air quality standards for ozone, once ORVR systems are in widespread use. The proposal sets June 30, 2013, as the date when “widespread use” will occur, and the Stage II waiver will be effective. EPA will accept comments on the proposed rule until September 13, 2011.
