On February 23rd, the SEC adopted technical amendments to Rule 17a-8 under the Securities Exchange Act of 1934 to update a reference in the rule to the implementing regulations of the Currency and Foreign Transactions Reporting Act of 1970, commonly referred to as the Bank Secrecy Act (BSA). The BSA's implementing regulations are promulgated and administered by the Financial Crimes Enforcement Network (FinCEN). The reference to the BSA's implementing regulations in Rule 17a-8 is being updated in response to FinCEN's reorganization of those regulations into a new chapter of the Code of Federal Regulations.
