The OGC has very recently issued its second consultation on the implementation of the amended Remedies Directive in the UK (which must take place by 20 December 2009). The key change is a new ability for courts to “render ineffective” public contracts which have been wrongfully awarded without proper competition or where no standstill period has been held. The Public Contracts Regulations 2006 (the Regulations) will be amended to take account of the changes to the directive, and the OGC has very recently published draft amendments to Regulation 32 and Part 9. We will report in more detail on this in the next edition of this newsletter. In the meantime, a copy of the consultation and the draft amendments is available here. The deadline for responding to the consultation is 24 July 2009.
