The Court of Appeal has reversed the guidance on costs given in R (Boxall) v Waltham Forest LBC that, where judicial review proceedings are resolved, each party should bear their own costs absent a good reason to make any other order. Where the defendant agrees to give the claimant relief, the defendant bears the burden of justifying a departure from the general rule that the unsuccessful party will be ordered to pay the costs of the successful party (R (Bahta) v Secretary of State for the Home Department).
