The Indiana Environmental Rules Board met on April 9, 2014, and passed the following air rulemaking actions:

  1. Amendments to Ozone and PM2.5 Standards, LSA #13-358,   which    amends   326    IAC    1-3-4 concerning the national air quality standards for the  2008  8-hour  ozone  standard  and  the  2012 annual PM2.5  standard. Filed with publisher July 8, 2014. Effective 30 days after filing.
  2. 2013 Code of Federal Regulation Update Rule, LSA # 13-501, which updates the references to the Code of Federal Regulations in 326 IAC 1-1- 3, 326 IAC 1-2-6.5, 326 IAC 11-6, 326 IAC 11- 9, and 326 IAC 20-95-1, updates a definition and removes obsolete language.
  3. Utility National Emission Standards for Hazardous Air Pollutants (NESHAP) Rule, LSA #13-488, which adds a new rule at 326 IAC 20- 89 concerning the NESHAP for coal- and oil-fired electric   utility steam generating units. Repeals 326 IAC 24-4 concerning the Clean Air Mercury Rule.

The Indiana Environmental Rules Board met on June 11, 2014, and passed the following air rulemaking actions with general application:

  1. Global Warming Potentials Table Update Emergency Rule, LSA #14-234(E), which updates the CO2e equivalent emissions calculations in 326 IAC 2-2-1(zz)(2)(A) and 326  IAC 2-7-1(40)(B)(i) with the 40 CFR Part 98, Subpart A, Table A-1 published in the Federal Register on Nov. 29, 2013.
  2. Sulfur Dioxide Designations Emergency Rule, LSA #14-233(E), which temporarily amends 326 IAC 1- 4-15, 326 IAC 1-4-50, 326 IAC 1-4-56, 326 IAC 1-4-64, and 326 IAC 1-4-85 to add the federal nonattainment  designations  for  the  2010  Sulfur Dioxide (SO2) Primary Standard for Veale Township in Daviess County; Center Township, Perry Township, and Wayne Township in Marion County; Clay Township and Washington Township in Morgan County; Washington Township in Pike County; and Fayette Township and Harrison Township in Vigo County.
  3. Global Warming Potentials Table Update Rule, LSA #14-56, which updates the CO2e equivalent emissions calculations in 326 IAC 2-2-1 and 326 IAC 2-7-1 with the 40 CFR Part 98, Subpart A, Table A-1 published in the Federal Register on Nov. 29, 2013.

No new KDAQ regulations or amendments to existing KDAQ regulations have been proposed or approved since the last issue of the Air Quality Letter.
