Effective September 23, 2013, Argentine tax residents are subject to a
flat tax of 15% on any gain resulting from the sale of shares of unlisted
corporations (i.e., companies whose shares are not traded on Argentine
stock exchanges), including shares acquired pursuant to equity compensation
awards granted by US multinationals.
Previously, gains realized from the sale of company shares generally were
not subject to taxation in Argentina.
For purposes of the new tax, Argentine tax residents include:
1. Any Argentine national who is not considered a permanent resident
of another country and has not spent more than 12 months abroad;
2. A foreign national permanently residing in Argentina pursuant to
apermanent residence permit; and,
3. A foreign national residing in Argentina for more than 12 months
pursuant to a temporary residence permit.
