On July 9, 2019, the National Intellectual Property Administration (CNIPA) released First Half of 2019 Statistical Data on Patent and Trademark.

 

Patent

In the first half of 2019, 649,000 invention patent applications were received by CNIPA, down 9.4% year-on-year and 238,000 invention patents were granted, up 9.9% year-on-year. The number of the invention patent applications filed by the foreign applicants reached 78,000, up 8.6% year-on-year. The top 3 countries for invention patent applications were Japan (up 12.6%), the United States (up 3.4%) and Germany (up 6.6%).

The companies (excluding Hong Kong, Macao and Taiwan regions) ranked top 3 for the invention patent grants were: Huawei Technologies Co., Ltd (2,314), China Petroleum and Chemical Corporation (1,595), Guangdong OPPO Mobile Telecommunications Corp., Ltd (1,312).

In the first half of 2019, 24,000 patent applications were filed through the Patent Cooperation Treaty (PCT), up 4.9% year-on-year, in which 22,000 applications were from China, up 2.8% year-on-year.

In the first half of 2019, CNIPA received 23,000 reexamination requests, up 22.9% year-on-year, and closed 17,000 cases, up 11% year-on-year. CNIPA received 2,800 invalidation requests, up 12.8% year-on-year, and closed 2,900 cases, up 18.9% year-on-year.

In the first half of 2019, the examination period of the invention patents was 22.7 months; the examination period of the high-value patents was 20.5 months; the examination period of the utility model patents was 6.2 months; the examination period of the design patents was 4 months; the examination period of the patent reexaminations was 11.7 months; the examination period of the invalidation requests was 5 months.

Trademark

In the first half of 2019, the number of trademark registration applications in China reached 3,438,000, down 4.1% year-on-year, the number of trademark registrations reached 3,515,000, up 67.8% year-on-year. The number of the trademark applications filed by the foreign applicants reached 12,700, up 15.4% year-on-year. The top 3 countries for trademark applications were the United States (up 12.6%), Japan (up 31.4%), and British (up 56.9%).

In the first half of 2019, the number of the trademark review applications reached 198,000, and 159,000 cases were closed. The number of Madrid international trademark registrations by the Chinese applicants reached 2,849. 

In the first half of 2019, the average examination period of the trademark registrations was reduced to less than 5 months; the period of trademark assignment was reduced to less than 4 months; the examination period of trademark reviews was reduced to less than 7 months; the examination period of the trademark change and renewal applications and the period of issuing the official filing receipt were reduced to less than 1 month.
