EPA Administrator Lisa Jackson signed a notice today that begins the process of reviewing the Bush administration’s denial of California’s waiver request. The anticipated reversal of the Bush administration position will allow California to regulate greenhouse gas emissions from vehicles. The signing of this notice kicks off a 60-day public comment period; thus, written comments are due by April 6, 2009. The EPA will also hold a public hearing in Washington, D.C. on March 5, 2009. The EPA is not clearly obligated to allow additional opportunities for the public to comment on California's waiver request; consequently, this written comment period and the associated public hearing may be the only meaningful opportunities available to private actors to have input on this EPA initiative.
