Today, the Ohio Supreme Court agreed to review the decision of the Franklin County Court of Appeals in Ohio Grocers' v. Levin, 178 Ohio App.3d 145, 2008-Ohio-4420.. The tax commissioner's brief in support of the appeal, and any amicus briefs that may be filed, are due 40 days after the record is filed with the Court from the court of appeals. It is expected that the record will be filed within the next few weeks. The appellees will then have 30 days in which to file their answer briefs, and the appellant will have 20 days thereafter to file a reply brief. It is unclear whether oral argument in the case will be held before, or after, the Court's summer recess.
