On 18 November 2013, a draft Food and Grocery Prescribed Industry Code of Conduct was released following over eighteen months of negotiations between the Australian Food and Grocery Council and supermarket retailers.

The voluntary code will regulate commercial dealings between retailers and suppliers, as well as provide for a dispute resolution process. The draft code imposes restrictions on the terms that can be included in agreements between suppliers and retailers, and provides protections for suppliers’ intellectual property rights.

The draft code will be considered by the Government and the ACCC, and a period of public consultation will follow before it is intended that the Code becomes a prescribed industry code under the Competition and Consumer Act 2010.
