Employees may file a complaint before the Commission de l’équité salariale , inter alia, when an employer has not completed a pay equity program within the required timeframe pursuant to the Pay Equity Act .

Until May 30, 2011, employees were able to claim retroactive salary adjustments, which could be have been calculated from the moment the business should have been in compliance with the Act, namely as far back as November 21, 2001.

However, as of May 31, 2011, employers are only liable to salary adjustments with respect to the last five (5) years.
