Part H of the Leveson Report contains detailed commentary on the DPA and the operation of the ICO. The ICO has issued a response to this. It accepts the recommendations in the Report relating to operational and policy matters – and will, ia, be developing new guidance both for the media and for individuals on data protection and the press in the coming months.
The Report also makes detailed recommendations for changes to the DPA. These will need to await developments on the draft General Data Protection Regulation to be taken forward. The ICO welcomes some of the recommendations for changes, but also notes that, overall, the recommendations would make the ICO close to a statutory regulator of the press, which would raise significant resourcing challenges.
