The victim fell over nine metres and sustained multiple injuries, including broken ribs, a fractured femur, a broken wrist, amnesia and head injuries. Due to the extent of his injuries, he spent 55 days in hospital after the incident. In NSW Industrial Court (on 03/12/2012) the roofing company was fined $75,000, while one of its family owners was fined $2750. Both parties pleaded guilty to breaching the Occupational Health and Safety Act and were ordered to pay an additional $15,000 in costs.
In pleading guilty, the roofing company acknowledged that they had failed to conduct a risk assessment and admitted that they had been using defective safety equipment. One of the owners, who was a close friend of the victim, was fined because he had failed to attend an interview with WorkCover investigators following the incident.
