In April this year, we reported on the Government's proposals to issue draft legislation and guidance on GMP equalisation.  To view the April briefing, click here.  In light of the difficulties in equalising GMPs, we have been involved in making representations to the DWP to refer a test case to the ECJ so that schemes can have conclusive legal comfort on the matter.  However, indications from the DWP are that no such test case will be referred to the ECJ as doing so will only extend the period of uncertainty surrounding the issue and that the DWP will work with pension groups to ensure that the guidance it proposes to issue achieves its objective of providing assistance to schemes.
