Further to the Supreme Court decision in R (on the application of Unison) v. Lord Chancellor, which held tribunal fees were unlawful, the government has announced that the first claimants eligible for fee refunds will be able to apply from today. The government has also confirmed that fee refunds will include an interest payment of 0.5 per cent.
Approximately 1,000 people will be individually contacted and given the opportunity to apply for refunds before the full scheme is opened. It is thought that this initial phase of the refund regime will last for four weeks, after which the government will provide further details. However, there is a pre-registration scheme for those that have paid tribunal fees that is also open now.
