On November 1, 2018, Germany will introduce a Declaratory Model Action (DMA) — Musterfeststellungsklage — which takes the form of a collective redress procedure. The DMA aims to facilitate the enforcement of consumer claims. Under the new law, a qualified entity will be able to bring actions on behalf of consumers to resolve legal or factual questions that are common to consumer claims. Notably, a number of businesses that participated in the political debate throughout the legislative process raised concerns that the law could lead to a surge in claims, similar to the US class actions regime.
