DFDS operates a sea transport network in Northern Europe and its main activities include Roll-on/Roll-off cargo shipping (Ro-Ro) and passenger shipping (Ro-Pax). Norfolk also operates Ro-Ro and Ro-Pax shipping as part of its sea transport services in Europe. The Commission had raised concerns that the merger could lead to capacity reductions and price increases in those particular shipping markets for UK-Scandinavia routes, and also a narrower UK-Denmark route.
DFDS submitted a number of conditions to the Commission including a Space Charter Agreement on the relevant routes, a transfer of certain third party customers, and greater flexibility with regard to volumes charted and the split of those volumes. In light of these remedies, the Merger was cleared by the Commission on 3 September 2010.
