The High Court has ordered a number of ISPs to block access to a website operating as an indexing and aggregation portal to unauthorised streamed broadcasts of sporting events by third-party streamers. The Court adopted the same approach to granting orders under 97A of the CDPA as it had done in previous decisions, even though the infringement issues in the case in hand were different as the site was not peer to peer. As there was a retransmission of a television broadcast to the public it was unnecessary to show that the public was a “new public”.
