On 21 December 2009, the European Commission (Commission) published for consultation a draft of a revised regulation and accompanying guidelines on motor vehicle sales and repair agreements. The current block exemption is due to expire in May 2010. The Commission takes the view that there is no need for sector specific rules covering agreements for the purchase, sale or resale of new motor vehicles and that these should be subject to the general rules applicable to vertical agreements. However, it is proposed that the current rules will remain in place for a transitional period to 31 May 2013 to allow the industry to make any necessary adjustments to their arrangements. Nevertheless, the Commission is proposing to adopt a new block exemption specifically covering agreements relating to spare parts and maintenance where competition to date appears to be more restrained. Interested parties have until 10 February 2010 to comment on the proposals.
