According to the European Commission (Commission), a series of contract awards by local authorities in Greece between 2003-2005 allegedly failed to comply with the public procurement rules applicable at the time (Directive 93/36/EC) in various ways. Among the failures highlighted by the Commission in its reasoned opinion to the Greek Government, was the frequent inclusion of criteria concerning the tenderers' ability to perform the contract as award criteria instead of selection criteria and a general failure by the local authorities to publish award notices after a contract had been concluded.
