Texas has simplified its data breach notification law, but in the process has made clearer that its law applies to personal data regarding the residents of any state. As we previously reported, Texas’ breach notification law formerly specified that it applied not just to information regarding residents of the Lone Star State, but also to data about residents of the few other states that did not have their own breach notification law. This apparently caused some companies some heartache, as they had to keep abreast of the dwindling number of states lacking such a law. So Texas enacted S.B. 1610, which makes clear that businesses must notify affected residents of every state, though notification that complies with another state’s law will also satisfy the Texas law’s requirements.
