Ofcom has published its decision that BT's pricing of residential broadband between June 2002 and December 2004 did not infringe either Chapter II of the Competition Act 1998 or Article 102 of the TFEU.

Following three statements of objections issued by Ofcom between September 2004 and October 2006 in relation to the alleged abuse of dominance, BT made detailed submissions which included new financial information and arguments as to the method Ofcom adopted in its financial analysis.

When considering the relevant market, BT's dominance in that market and whether BT applied a margin squeeze between June 2002 and December 2004, Ofcom found it had insufficient evidence to support a finding of abuse of dominance by BT. Further, Ofcom found that from 1 January to 31 December 2004 BT had not been involved in a margin squeeze.
