On 5 June 2014, Disbury Holdings Pty Ltd t/as Gotta Getta Group (Gotta Get) paid $20,400 in penalties for alleged misleading representations in advertisements regarding its solar systems.

The ACCC issued two penalty notices alleging that Gotta Getta’s radio, TV and internet advertisements for solar systems falsely represented that:

  • the South Australian government’s 60 cent feed-in tariff offer meant that consumers could recoup their solar system investment purchased from Gotta Getta up to three times faster than a solar system purchased from another supplier, when in fact consumers who purchased a solar system from another supplier would receive the benefit of the 9.8 cent minimum retailer payment in addition to the 16 cent South Australian Government feed-in tariff; and
  • consumers did not need to make any financial contribution to receive the 60 cent feed-in tariff offer, when in fact consumers were required to enter into a three year energy plan with Simply Energy to take up the offer and Gotta Get included a commission payable by Gotta Getta to Simply Energy in the purchase price of the solar systems.
