A recent decision of the High Court has clarified the circumstances in which the issue of a Claim Form will constitute an abuse of the court process. The case in question involved a Claim Form being issued in circumstances where little had been done by the claimant to analyse the factual or legal bases of its claims. The case also affirms that the only proper sanction for such an abuse of process is striking out of the claim.
